CRITERIOS PARA DETERMINAR LAS “PARTES ÍNTIMAS” EN EL DELITO DE ACTOS CONTRA EL PUDOR EN (ARTÍCULO 176A DEL CÓDIGO PENAL PERUANO)

Abstract

El presente trabajo de investigación realiza un estudio exhaustivo de la conducta típica del delito de Actos Contra el Pudor en Menores, a efecto de establecer parámetros y valoraciones adecuadas que alejen la naturaleza repudiable del delito del examen del juez sobre la conducta fáctica del agente y que pueda influir (involuntariamente) en su decisión, parcializando su valoración exclusivamente en la manifestación del sujeto pasivo.

This research work carries out an exhaustive study of the typical conduct of the crime of Acts Against Shame in Minors, in order to establish adequate parameters and evaluations that remove the reprehensible nature of the crime from the judge's examination of the factual conduct of the agent and that may influence (involuntarily) their decision, biasing their assessment exclusively on the manifestation of the taxpayer.
