EVALUACIÓN DE TÉCNICAS JURÍDICAS APLICADAS EN LA CASACIÓN N° 1690-2017-AMAZONAS, SOBRE REPARACIÓN CIVIL EN CASOS DE SENTENCIAS ABSOLUTORIAS Y EXTENSIÓN DEL RECURSO

Abstract

Revisado las investigaciones referidas a la evaluación de técnicas jurídicas aplicadas en las Sentencias de Casación, se ha verificado que existe deficiente aplicación de tales técnicas de parte de los jueces supremos. A partir de estas premisas, el investigador, se propuso evaluar si las técnicas de interpretación, integración y argumentación, aplicadas en la Casación N° 1690-2017-Amazonas, sobre reparación civil en casos de sentencias absolutorias y extensión del recurso, se enmarcan dentro de los parámetros administrativo, legislativo y doctrinario, vigentes en el sistema jurídico de nuestra patria.

Having reviewed the investigations related to the evaluation of legal techniques applied in the Cassation Judgments, it has been verified that there is a deficient application of such techniques by the supreme judges. Based on these premises, the researcher set out to evaluate whether the interpretation, integration and argumentation techniques, applied in Cassation No. 1690-2017-Amazonas, on civil reparation in cases of acquittal sentences and extension of the appeal, are framed within of the administrative, legislative and doctrinal parameters, in force in the legal system of our country
