ANÁLISIS DE TÉCNICAS DE ARGUMENTACIÓN APLICADAS EN LA SENTENCIA DE PRIMERA INSTANCIA DEL EXP. N° 2993-2016-12-3ER JUP DE TRUJILLO Y LA ESPERANZA, SOBRE EL DELITO DE CONDUCCIÓN EN ESTADO DE EBRIEDAD

Abstract

En las investigaciones realizadas referente al análisis de las técnicas jurídicas de argumentación aplicadas en sentencias de primera instancia, se han identificado que existen deficiencias aplicación de dichas técnicas de parte de los jueces. A partir de dicha información, la investigadora, se formuló como propósito analizar si las técnicas de argumentación jurídica, aplicadas en la Sentencia de primera instancia del Exp. N° 2993-2016-12-Tercer Juzgado Penal Unipersonal de Trujillo y la Esperanza, sobre el delito de conducción en estado de ebriedad, se enmarcan dentro de los parámetros administrativo, legislativo y doctrinario, vigentes en nuestro sistema jurídico.

In the investigations carried out regarding the analysis of the legal techniques of argumentation applied in first instance judgments, it has been identified that there are deficiencies in the application of said techniques by the judges. Based on said information, the researcher formulated the purpose of analyzing whether the legal argumentation techniques, applied in the Judgment of first instance of File No. 2993-2016-12-Third Single-person Criminal Court of Trujillo and La Esperanza, on the crime of driving while intoxicated, are framed within the administrative, legislative and doctrinal parameters, in force in our legal system.
