ANÁLISIS DE LAS TÉCNICAS JURÍDICAS DE INTERPRETACIÓN, INTEGRACIÓN Y ARGUMENTACIÓN APLICADAS EN LA SENTENCIA DE CASACIÓN PENAL N° 1113-2018-CUSCO

Abstract

En los antecedentes de investigación relativos a la evaluación de técnicas jurídicas aplicadas en las Sentencias de Casación Penal, se ha verificado que existen deficiencias aplicación de dichas técnicas de parte de los jueces supremos. Sobre la base de dichas premisas, el investigador, se propuso analizar si las técnicas jurídicas de interpretación, integración y argumentación, aplicadas en la Sentencia de Casación Penal N° 1113-2018-Cusco, relativo a la precisión sobre la evaluación de las garantías de certeza en la declaración de la agraviada, se encuadran dentro de los parámetros legislativo, administrativo y doctrinario, vigentes en el sistema jurídico peruano.

In the investigation background related to the evaluation of legal techniques applied in the Criminal Cassation Judgments, it has been verified that there are deficiencies in the application of said techniques by the supreme judges. On the basis of these premises, the investigator proposed to analyze whether the legal techniques of interpretation, integration and argumentation, applied in Criminal Cassation Judgment No. 1113-2018-Cusco, regarding the accuracy of the evaluation of the guarantees of Certainty in the statement of the aggrieved, fall within the legislative, administrative and doctrinal parameters, in force in the Peruvian legal system.
