CRITERIOS PARA DETERMINAR LA CUANTÍA DE LA REPARACIÓN CIVIL EN EL DELITO DE CONDUCCIÓN EN ESTADO DE EBRIEDAD

Abstract

El presente estudio de investigación surgió de la incertidumbre que generan las escasas motivaciones que utilizan los administradores de justicia al determinar la cuantía de la reparación civil por la comisión del delito contra la seguridad pública - Conducción en Estado de Ebriedad y/o Drogadicción, en las cuales (en su mayoría) señalan una cuantía de mil nuevos soles por concepto de reparación civil, sin motivar de manera alguna, cómo es que se cuantificó dicho monto o bajo qué criterios se debe señalar la mencionada reparación civil.

This research study arose from the uncertainty generated by the limited motivations used by administrators of justice when determining the amount of civil compensation for the commission of the crime against public safety - Drunk Driving and / or Drug Addiction, in the which (for the most part) indicate an amount of one thousand new soles for civil damages, without giving reasons in any way, how this amount was quantified or under what criteria the aforementioned civil compensation should be indicated.
