ANÁLISIS DE LOS ALCANCES DE LA BUENA FE REGISTRAL ENTIDADES FINANCIERAS

Abstract

En el presente trabajo de investigación se podrá advertir que no tener claro los parámetros del alcance y protección de la buena fe registral podría dañar de manera irreversible e injustificada los derechos de propiedad favoreciendo los derechos personales. Lamentablemente, es con dicha incongruencia con la que obran ciertos juzgados respecto a la debida protección que corresponde al derecho de propiedad frente a derechos personales, lo que genera procesos de nulidad de acto jurídico (inscripción) lo que genera una carga procesal innecesaria. En dicho contexto, es que se seleccionó el tema del presente esfuerzo intelectual. La buena fe registral es un principio recogido por nuestra norma sustantiva civil a fin de proteger al tercero adquirente de buena fe. Sin embargo, ¿cuán diligente debe ser este tercero, ya sea para adquirir o para gravar un bien inmueble?, la respuesta a este cuestionamiento no se advierte con la claridad correspondiente, debido a que los alcances de la buena fe registral no se encuentran debidamente puntualizados, es decir, qué debidas diligencias acreditan que determinada persona o entidad se encuentra bajo la protección del principio de la buena fe registral.

In this research work, it may be noted that not being clear about the parameters of the scope and protection of good faith in the registry could irreversibly and unjustly damage property rights favoring personal rights. Unfortunately, it is with this incongruity that certain courts act with respect to the due protection that corresponds to the right of property against personal rights, which generates processes of nullity of the legal act (registration) which generates an unnecessary procedural burden. It is in this context that the subject of the present intellectual endeavor was selected. Registry good faith is a principle set forth by our civil substantive rule in order to protect the third-party purchaser in good faith. However, how diligent must this third party be, either to acquire or to encumber a real estate? The answer to this question is not seen with the corresponding clarity, because the scope of good faith in the registry is not properly found. Specified, that is, what due diligence proves that a certain person or entity is under the protection of the principle of good faith in the registry.
