Abstract

La presente declaración fue en presencia del abogado defensor de oficio asignado al investigado Víctor Alberto Cotaquispe Valerio iniciada el día 21 de octubre del dos mil doce a las diecinueve horas con ocho minutos ante el local del Juzgado de Turno de Lima, la misma que fue suspendida para continuarse con su declaración por ante el Juzgado que tramitará su expediente Que, ante el Trigésimo Octavo Juzgado Penal de Lima- Reos en Cárcel con fecha seis de noviembre del dos mil doce, al procesado se le traslado a la Sala de Audiencias del Establecimiento Penal de Lurigancho, con la finalidad de Recepcionar la continuación de Declaración Instructiva del procesado Víctor Alberto Cotaquispe Valerio, encontrándose el Representante del Ministerio Público Dr. Juan Carlos Mezzich Alarcón; se suspende la diligencia por no encontrarse su abogado defensor. En la Sala de Audiencias del Penal de Lurigancho, a los quince días del mes de noviembre del dos mil doce, el procesado Víctor Alberto Cotaquispe Valerio manifiesta que no reconoce los hechos imputados y que se considera inocente. Que, el día de los hechos siendo aproximadamente las seis y media o siete de la noche, señala que se encontraba libando licor en la puerta de mi casa con un amigo a quien conozco como Luis de pronto se apareció una camioneta policial de la Comisaría Santa Elizabeth, se bajó un policía y me intervino y me indicó que un señor quien estaba en la camioneta lo estaba sindicando como autor del robo de su celular, lo enmarrocaron y lo subieron y fue conducido a la comisaría.
